Penalties for DUI

Under Act 24, a driver can receive DUI charges with a blood-alcohol content (BAC) of .08% or greater.

Pennsylvania upholds a tiered punishment system that increases in severity with the number of offenses and the extent to which the driver’s BAC surpasses the legal limit.

DUI punishment varies within three categories for impairment — general impairment, high BAC and highest BAC. Within these categories, the driver’s penalties will depend on the number of offenses.

All categories of DUI involve some level of misdemeanor charge, a fine and court-ordered alcohol highway safety education — if the first or second offense. Punishment may also include behavioral health treatment, probation, prison time, license suspension and the implementation of an ignition lock on the driver’s vehicle.
