How Pennsylvania Courts Determine Child Support

Pennsylvania courts decide child support payments by considering which parent spends the most time with the child and calculating typical costs associated with raising a family. They consider a child’s basic needs, such as access to food, a safe home, clothing, medical care and education. Courts may also include child care, basic travel expenses, extracurricular activities and insurance in their calculations.

Courts will then consider each parent’s ability to pay, looking at their income sources and their earning capacity. All income sources are considered for child support, including bonuses, 401(k) contributions and overtime. Voluntarily reducing income does not typically change earning capacity.

When determining child support payments, Pennsylvania courts will also consider factors such as:

  • Where the child lives
  • Differences in parental income
  • A child’s special needs
  • How many children are involved

How Is Child Support Determined for Equal Custody Cases?

If custody is split equally between parents, the higher-earning parent will typically pay child support to the lesser-earning parent. Pennsylvania courts look at various factors when determining payments, though, including:

  • The number of children involved
  • Each parent’s income after taxes
  • Certain additional expenses

The goal of child support in equal custody cases is to ensure the children maintain the same quality of life in each parent’s household. If both parents’ incomes are similar, the court may not require child support payments from either parent.
