What Is PFA?

A Protection From Abuse (PFA) order prevents one party, an individual accused of abuse, from having contact with another party, an individual or children. Contact includes harassment, abuse, stalking and any type of communication. A PFA order is similar to a restraining order in other states.

Individuals in domestic violence situations can seek a PFA order from the court if they need protection. The court can issue a PFA order if there is an imminent fear of immediate bodily harm or injury, though it can be complicated to know if your situation applies. How Do PFAs Work?

A PFA order can be created for those in family or intimate relationships. PFAs do not apply to co-workers, neighbors or strangers. Applicable relationships include:

  • Individuals who have a child together

The PFA process follows a few steps:

  1. The plaintiff, or the person accusing an individual of abuse, applies for a temporary PFA with the local court.
  2. A judge sets a date for a final hearing and can order a temporary PFA.
  3. The police serve the PFA and hearing date notification to the defendant, or the individual accused of abuse.
  4. At the hearing, both parties present evidence and witnesses to support their cases.
  5. The judge determines whether to issue a final PFA order.

PFA orders can last up to three years, but the judge will determine the length during the hearing. If the defendant violates the PFA order when it is active, the PFA order can be extended for up to an additional three years.
